These terms govern your use of the indigopress.eu website and of IndigoPress, a self-hosted publishing content management system ("the Software") supplied by Kristoffer Hell, registered in Switzerland ("we", "us", "IndigoPress"). By using this website, or by downloading or installing IndigoPress, you agree to these terms.

1. What IndigoPress is

IndigoPress is proprietary software that you download and run on your own hosting. Licensing is arranged directly with us on request. Contact us to discuss a licence for your use case.

2. Licence

Any licence we grant is non-exclusive and non-transferable, and authorises you to install and use IndigoPress for the purposes set out in writing between us. You may modify the Software for your own use. You may not redistribute the Software, sub-license it, resell it, or remove the copyright notices.

IndigoPress is proprietary software and is not open source. The Software, including all copies and modifications, remains the intellectual property of IndigoPress.

3. Your content

Content you publish through IndigoPress is and remains yours.

4. Acceptable use

You agree not to use IndigoPress for the following:

  • Content or activity that is illegal in your jurisdiction or in ours.
  • Infringement of third-party intellectual property, copyright, or trademarks.
  • Sending unsolicited bulk mail (spam) through the newsletter feature.
  • Distributing malware, spyware, or other malicious or destructive code.
  • Content that calls for harm to others.
  • Publishing private personal information about others without their consent.
  • Impersonating real people or organisations (parody and satire excepted).
  • Reverse-engineering IndigoPress to bypass licence checks, redistributing the Software, or removing copyright notices.

We reserve the right to terminate access where these terms are breached.

5. Updates and changes

We may release software updates or discontinue features.

6. Support

Paid support may be available on request. Contact us to discuss. Otherwise, see the documentation that ships with IndigoPress.

7. Disclaimer and liability

IndigoPress is provided "as is", without warranty of any kind. We are not liable for loss of data, loss of revenue, or any consequential damage arising from use of the Software.

Our maximum aggregate liability under these terms is limited to the fees you have paid to us in the twelve months before the event giving rise to the claim.

8. Termination

You may stop using IndigoPress at any time. We may terminate these terms for breach. Termination does not affect rights or obligations that have accrued before termination.

9. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page reflects the current version.

10. Severability

If any provision of these terms is found to be invalid or unenforceable in a particular jurisdiction, that provision will be read down to the minimum extent necessary to make it enforceable, or removed if that is not possible. The remaining provisions stay in full effect.

11. Governing law

These terms are governed by the laws of Switzerland. Any dispute arising from these terms will be brought before the competent Swiss courts, except where consumer-protection law in your country grants you the right to bring an action in your local courts.
